Authorisations
|
The Authorisations Department is responsible for examining applications for granting licenses to entities that fall under the scopy of CySEC. Specifically CIFs, UCITS Management Companies, Alternative Investment Fund Managers (AIFMs), Companies Providing Administration Services and UCITS. Also, the Department examines several applications such as applications to extend the license of the above organizations, for changes in the ownership structure and changes in the persons who direct their activities, notifications for providing services across borders through the freedom to provide services or through establishing branches, notifications of UCITS Management Companies or an AIFM to dispose UCITS or AIFs (Alternative Investment Funds) to other Member States, etc.
The duties of the Authorisations Department mainly includes:

The examination of applications for granting licenses to CIFs, UCITS Management Companies, Alternative Investment Fund Managers (AIFMs), Companies Providing Administration Services and UCITS

The examination of applications for granting licenses to UCITS distributors, Regulated Markets, central counterparty clearing and settlement of OTC derivatives, OTC derivatives trade repositories and central securities depositories

The examination of applications for the extension of license of the above organizations, changes in the ownership structure and changes in the persons who effectively direct their activities

The acceptance of CIF notifications, UCITS Management Companies and Alternative Investment Fund Managers to provide services across borders or by establishing branches

The acceptance of UCITS Management Companies notifications or AIFM for the disposal of UCITS or AIF (Alternative Investment Fund) to other Member States or, in the case of AIFM, to Third Countries

The acceptance of CIF notifications, UCITS Management Companies or AIFM of other Member States to provide services in the Republic either through the freedom to provide services or by establishing branches

The acceptance of UCITS notifications or other EU member states for the disposal of UCITS in the Republic

The acceptance of AIFM notifications of other EU member states or Third Countries for the disposal or the establishment and management of the AIF in the Republic.
